Are you open to a few suggestions?
SUGGESTION #1: Using Yellow page ads, mailers, web sites, Oregon State Bar referral programs, are not the best ways to choose a lawyer. The best method is to request a referral from your family or corporate counsel. If you do not have such a resource, referrals from police officers, court staff, judges are good sources of information. Unfortunately, it is sometimes difficult to get the name of the DUI lawyer that attorneys and officers go to when they have "issues" that need "attention".
SUGGESTION #2: As a general rule, when choosing a lawyer to defend you on a Drunk Driving charge, it is best if that lawyer focuses 100% on DUII defense.
Unfortunately, it is sometimes difficult to find an attorney dedicated 100% to criminal defense who is not a public defender. You cannot hire a public defender. Most lawyers who handle criminal cases also handle non-criminal matters such as divorce or personal injury. That is not to say that such attorneys will not provide you fantastic service and results. But, it is a crap shoot.
SUGGESTION #3: Compare the credentials of the lawyers before you make a decision to retain.
All attorneys may be created equal but that does not mean they can perform at the same level or that they are trained the same. Some people have more talent than others. Some people train themselves to the point that they excel in certain areas.
SUGGESTION #4: If you have never been arrested for DUI before, you need to know about diverting your case from criminal prosecution. Generally, diverting the DUI case from criminal prosecution is the most popular method of resolving the DUI charges. It is the right choice for most folk, but not all. You need to know if the case can be dismissed after a "supression" motion in order to make an informed decision.

LAW QUESTIONS.
This homepage is dedicated to answering the most basic of questions that a citizen accused of DUI, DUII, DWI, Drunk Driving, or Driving Under the Influence of Intoxicants may want answered. I hope that you find this page informative. The terms DUI, DWI and DUII will be used interchangeably throughout this site.
Q: What is the difference between a DUI, DUII, DWI, Drunk Driving, Driving under the influence of intoxicants?
DUI stands for Driving Under the influence. DUII stands for Driving Under the Influence of Intoxicants. DWI stands for Driving While Intoxicated or Driving While Impaired. In Oregon, the legal terminology is DUII; standing for Driving While Under the Influence of Intoxicants. This term is most often shortened to DUI among Oregon lawyers and attorneys. DUII or Driving Under the Influence of Intoxicants is defined as operating a motor vehicle while having a blood alcohol content of .08 by weight or being adversely affected to a noticeable or perceptable degree by the intoxicating effects of liqour; such that the individual looses his/her normal clarity of thought and control that he/she would otherwise possess. Some States use the term DUI to define the offense. Virtually all States prohibit operating a vehicle with a .08 by weight of alcohol in the driver's blood. Where the states differ is on the definition of being "under the influence." Some states define DUI as the inability to operate a vehicle in a safe manner after the consumption of an intoxicant. Other states look to whether the individual is "less able" to operate the vehicle safely. Other states define being "under the influence" of alcohol as being affected by the alcohol to the "slightest degree." DUI, DUII, DWI are terms used by lawyers and attorneys interchangeably. You should contact a DUI attorney or lawyer.
Q: What information do I need to know from an Oregon attorney or lawyer if I've been charged with an Oregon DUI offense?
DUI in Oregon is a class "A" misdemeanor crime which means that the court may impose a maximum sentence of up to one year in jail and a fine of $6,250. A DUI may be a class "C "felony if the motorist has been convicted on three prior occassions of DUI within 10 years prior to the date of current alleged offense. If convicted, the motorist will suffer a lifetime driver's license revocation and a prison term exceeding one year. If the motorist is convicted of a third offense DUI, the court will impose a lifetime driver's license revocation. On a first or second DUI conviction, the court ordered license suspension is either one year or three years, depending upon whether the motorist had a prior DUI within 5 years of the current offense. It is fair to assume that the greater the number of prior DUI arrests a motorist has in his/her past, the greater the likelihood of significant jail sanction, fines and license suspension. You should contact a lawyer or attorney to answer your specific questions.
Q: Will my license to drive be suspended of revoked?
A motorist who is arrested for Oregon DUII has two opportunities to have a license suspension imposed. It is important for the DUII accused motorist not to miss any opportunity to contest the fight off the license suspensions. To take advantage of the first opportunity the motorist must contact an attorney within 10 days of the DUII arrest. The attorney will then contact the Department of Motor Vehicles (DMV) and make a specific request for a hearing to contest the proposed license suspension resulting from a breath test failure or refusal. Making a timely request for this hearing is mandatory. The DMV license suspension hearing is the DUII accused motorist's best opportunity to discover the strengths and weakness of the state's case. The officer who charged the motorist with DUII must attend the hearing and establish compliance with the relevant rules and procedures governing breath testing. The DUII arresting officer is subject to questioning by the DUII motorist's attorney. The entire proceeding is recorded and the testimony is under oath. If the alleged DUII motorist prevails at the DMV hearing, there is a probability that the the state's criminal case will fail if the issue is pressed. If the DUII motorist "wins" at the DMV Hearing and the lawyer is able to have the criminal DUII case dismissed or otherwise disposed of without a DUII conviction, the motorist will not suffer a license suspension. You should contact a DUII attorney to answer your specific questions.
Q: What if I am arrested in Oregon but I have an out of state driver's license?
If you are arrested for DUII in the State of Oregon and you are convcited of DUII, the state that issued your license will be notifed by Oregon of the DUII conviction. The issuing state will then suspend your license for the DUI Iconviction based upon the unique laws of that state. If you are arrested for DUII in Oregon and are not convited of DUII, the home state will not be notified. However, if the motorist suffered a DMV administrative license suspension pursuant to Oregon's implied consent laws for a breath test failure or refusal, based on a DUII arrest, the home state should be notified, but that does not always occur. In that situation, the motorist will have his privilege to drive a car in Oregon suspended but may drive in any other state of the union. You should contact a DUII attorney to answer your specific questions.
Q: Do I need a lawyer and how much do lawyers cost?
No, you do not "NEED" and lawyer, but it is very wise to at least consult with one.
Lawyers will charge anywhere from $500 to $20,000 for a DUI Defense depending upon the complexity of the case. Obviously, the better DUII lawyers are specialists that generally charge more than the less experienced lawyer. That said, there are very fine young lawyers in Oregon who I would be pleased to recommend if you are unable to afford my services.
Q: Will I be able to have my Oregon DUI charge reduced to a lesser offense by plea bargaining?
Unfortunately, plea bargaining a Oregon DUI to a lesser offense such as reckless driving, wet reckless, or any other offense is now prohibited by statute. (ORS 813.170). That said, it has been our experience that reasonable prosecutors are creative and are not totally hamstrung by the statute.
Q: Can I have a Oregon DUI conviction, Oregon DUI arrest, or Oregon DUI diversion taken off my record?
In Oregon, a DUI conviction, DUI arrest or DUI diversion can never be taken off your record. (ORS 137.225(6)(a)) Traffic offenses are forever in Oregon. You should contact a DUI lawyer or attorney to answer your specific questions.
Q: What are the fines for a DUI conviction in Oregon?
The minimum fine is $1000 on the first DUI conviction. A second DUI conviction will cause a minimum fine of $1500. A third DUI conviction will cause a minimum fine of $2000. The court may impose a maximum fine of $6250 for a midemeanor DUI. Some jails require a per diem for each day of incarceration...figure $100 per day. The court will impose miscellaneous fees and assessments totalling in the neighborhood of $500, the alcohol evaluation is approximately $100-$150, the victim impact panel is anywhere from $20-$50, and the cost for alcohol treament is dependant on the quality of care you chose to recieve. The better the treatment, the more it costs. You should contact an Oregon DUI lawyer or Oregon DUI attorney to answer your specific questions.
Q: What if I am a CDL Holder and I am arrested for Oregon DUI while driving my personal vehicle?
Having a CDL places the motorist in a difficult possition. Federal Rules require the State of Oregon to prohibit such motorists from entering diversion. If the CDL holder is convicted of DUI, the ramifications for the suspension of the CDL are severe. The issues are complex, but there is action that can be taken to mitigate the potential for harm. A very good Oregon DUI lawyer or Oregon DUI attorney can help. Time is not the friend of the CDL holder charged with DUI.
